ShotWot End User License Agreement (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and ShotWot ("Company," "we," "us," or "our"), governing your use of the ShotWot mobile application and associated services ("App" or "Services"). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.
1. Acceptance of Terms
By accessing and using the App, you agree to comply with and be bound by this Agreement. If you do not agree with any part of this Agreement, you must not use the App.
2. Description of Services
ShotWot is a production company that operates through web and app platforms, allowing users to create media assets in return for monetary rewards. Users can apply for shoot briefs, sign formal agreements for tasks, and receive rewards upon successful completion. Rewards accumulate in the ShotWot App's Wallet and can be withdrawn in cash or converted into vouchers or gift cards. Users can also purchase stock media assets from the ShotWot Shop and subscribe to the ProShooter Plan for additional features.
3. Eligibility
To use the App, you must be at least 18 years old and capable of forming a binding contract under applicable law. By using the App, you represent and warrant that you meet these eligibility requirements.
4. Account Registration and ID Verification
4.1. To access certain features of the App, you must create an account and complete the ID verification process.
4.2. You agree to provide accurate, current, and complete information during the registration and ID verification process.
4.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Usage Terms
5.1. You may use the App for lawful purposes only and in accordance with this Agreement.
5.2. You agree not to use the App:
In any way that violates any applicable local, national, or international law or regulation. To exploit, harm, or attempt to exploit or harm minors in any way.
To send, knowingly receive, upload, download, use, or re-use any material that does not comply with our content standards. To transmit any advertising or promotional material without our prior written consent.
6. Intellectual Property Rights
6.1. The App and its entire contents, features, and functionality are owned by ShotWot, its licensors, or other providers of such material and are protected by intellectual property laws.
6.2. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.
7. Content Ownership Rights
7.1. Users retain ownership of the media assets they create. However, by submitting such content to ShotWot, you grant ShotWot a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable licence to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Services.
8. Privacy Policy
8.1. We value your privacy and are committed to protecting your personal data. Please refer to our Privacy Policy for details on how we collect, use, and disclose your information.
9. Reward System and Wallet
9.1. Users earn rewards for completing tasks as per the shoot briefs.
9.2. Rewards are accumulated in the ShotWot App's Wallet.
9.3. Users can withdraw the rewards in cash or convert them into vouchers or gift cards, subject to applicable conversion rates.
10. ProShooter Plan Subscription
10.1. Users can subscribe to the ProShooter Plan, a lifetime membership plan granting access to additional features.
10.2. Subscription fees for the ProShooter Plan are non-refundable.
11. Refund Policy
11.1. Purchases of any media assets done through ShotWot Shop are final and non-refundable except as required by applicable law.
11.2 Purchase of ProShooter subscriptions if unintended, you may request a refund within 48 hours of the deduction from your bank account. ShotWot is obligated and committed to refunding the amount within 45 days of the request being raised.
12. Indemnification
You agree to defend, indemnify, and hold harmless ShotWot, its affiliates, licensors, and service providers,and their respective officers, directors, employees,and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Agreement or your use of the App, including, but not limited to, your User Contributions, any use of the App's content, services, and products other than as expressly authorised in this Agreement, or your use of any information obtained from the App.
13. Limitation of Liability
13.1. To the fullest extent permitted by applicable law, ShotWot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of or inability to access or use the App;
Any conduct or content of any third party on the App;
Any content obtained from the App; and
Unauthorized access, use, or alteration of your transmissions or content.
13.2. In no event shall ShotWot's aggregate liability for all claims related to the App exceed the greater of the amount you paid us, if any, in the past twelve months for the services giving rise to the claim.
14. Compliance with Laws
You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of the App.
15. Privacy Protection
15.1. ShotWot is committed to protecting your privacy. We will only use your personal information as outlined in our Privacy Policy.
15.2. By using the App, you agree to the collection, use, and sharing of your information in accordance with our Privacy Policy.
16. Intellectual Property Rights
16.1. The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by ShotWot, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
16.2. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as follows:
- Your computer
- Your Tablet PC
- Your Mobile Device
- Your Laptop
or any other devices may temporarily store copies of such materials incidental to your accessing and viewing of the App. You must not modify copies of any materials from the App, use any illustrations, photographs, video or audio sequences, or any graphics separately from accompanying text, or delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the App.
17. Termination
17.1. ShotWot may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement.
17.2. Upon termination, your right to use the App will immediately cease. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
18. Changes to Agreement
18.1. ShotWot reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
19. Governing Law
19.1. This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.
